CASE UPDATE – Case against the Removal of Transport licence for Sand and Soil CA Writ 12/2020

This case was filed on 17th January 2020 against the Cabinet Decision taken on 04.12.2019 with regard to the removal of the existing requirement on obtaining permits/licenses for the transportation of sand, soil and clay necessary for the local industries and the construction industry as required under Section 28 of the Mines and Minerals Act No.33 of 1992. The petitioners also request an interim order suspending the said Cabinet Decision. It was fixed to be mentioned on 24th January 2020 in Court of Appeal. All Respondents were absent except 17th Respondent who is the Geological Survey and Mines Bureau. Petitioners were informed by the Court to send the Notices to all Respondents except the 17th Respondent. Petitioners sent the Notices on 3rd February and filed the motion to the court on 5th of February 2020. This case was re-fixed for support on 24th March 2020. However, as a result of declaration of the special holidays by the government due to Corona virus Pandemic, this case is also postponed without a due date. On 17th July 2020 the court issued an order directing the Inspector General of Police to act according to the law in the Mines and Minerals Act and take note of the contents of the order. The case was terminated on 16th February 2021 after directing the AG to inform the IGP to act according to the given order. [END]
