In the pursuit of upholding environmental integrity and legal transparency, the CEJ initiated a significant legal action by lodging a Fundamental Rights (FR) petition with the Supreme Court. The petition challenges perceived irregularities in the licensing process involving foreign companies excavating the Eppawala phosphate deposit, a vital national asset.

Filed on December 12, 2023, by Mr. Dilena Pathragoda, Executive Director of CEJ, and Mr. Hemantha Withanage, Senior Adviser, the petition alleges the utilization of forged documents in granting approval to foreign firms, resulting in substantial financial losses for the state. CEJ contends that entrusting such a valuable resource to foreign entities disproportionately favors them, to the detriment of Sri Lankan interests.

The petitioners seek a Supreme Court order for a special investigation into the matter, urging the appointment of a Presidential Commission of Inquiry (PCoI). Additionally, they request legal action against those responsible under criminal laws, emphasizing the need for accountability and rectification. On 1st of September 2025, the Court grants leave to proceed under Article 12(1) of the Constitution.
