The case of SC/FR 168/21 concerned the MV X-Press Pearl maritime disaster, the largest recorded marine plastic spill in the world, which occurred when the vessel caught fire and sank off the coast of Colombo. This is a landmark case in the domain of environmental law. The MV X-Press Pearl was a ship from Singapore carrying 1,486 containers. The unfortunate voyage started with a container of nitric acid which had broken, and which had been refused discharge at several ports, such as Hamad (Qatar) and Hazira (India), prior to the approach of Colombo, Sri Lanka The incident is a violation of the right to a clean and safe environment, now and for future generations. The petitioners, including the Centre for Environmental Justice and others, filed against respondents including the Marine Environment Protection Authority (MEPA) and other state bodies and also Ship’s owners, operators and agents. Key issues of the case connected with the responsibility for the disaster, violations of fundamental rights, the adequacy of the state's response, the application of the Polluter Pays principle and the Court's jurisdiction.

In this case the Court declared that the Fundamental Rights of the Petitioners under Articles 12(1) and 14(1)(g) of the Constitution had been infringed due to the failure of state authorities. The Polluter Pays principle, as applied in this case, is a cornerstone of modern environmental law. In the context of the MV X-Press Pearl disaster, the Supreme Court’s order of USD 1 billion as an initial compensation represents the practical enforcement of this principle on an unprecedented scale in Sri Lanka. It sends a clear message that international shipping operators and their insurers will be held strictly accountable for environmental damage caused within Sri Lankan waters. Beyond providing funds for immediate restoration, the application of this principle also contributes to long-term governance by embedding accountability into both state regulation and corporate responsibility.To oversee compensation and restoration, two new bodies were established, the MV X-Press Pearl Compensation Commission, chaired by a retired Justice of Supreme Court E.A.G.R. Amarasekera, and the MV X-Press Pearl Marine and Coastal Environment Restoration and Protection Committee, chaired by the Secretary to the Ministry of Environment (ex-officio). 

In addition, in this case the court maintains the ongoing supervision by order to submit progress reports to the Supreme Court every three months. For long-term legal reform, the Attorney General was tasked with carrying out two studies: first, a “gap analysis” to identify discrepancies between Sri Lanka’s maritime laws and international standards; and second, a study on possible amendments to the Marine Pollution Prevention Act and the Coast Conservation Act.

The SC/FR 168/21 case arising from the MV X-Press Pearl disaster, while tragic in its environmental and social consequences, has had several positive impacts on Sri Lanka’s legal system, governance, and environmental protection. Critically, it reaffirmed the judiciary’s role in safeguarding fundamental rights, and broadened the constitutional interpretation of Articles 12(1) and 14(1)(g) to include environmental justice. The Court ordered also advanced accountability by directing state authorities, law enforcement, and regulatory bodies to act with urgency and transparency, while applying the “polluter pays” principle to secure unprecedented financial compensation for restoration. Institutionally, the creation of dedicated commissions for compensation and marine restoration set a precedent for specialized bodies to address large-scale environmental disasters. Further, the Court’s insistence on continuous supervision, reforms in maritime law, and alignment with international standards may strengthen Sri Lanka’s environmental governance in the long term. Thus, despite the disaster’s devastating harm, the case critically pushed forward legal recognition of environmental rights, institutional reforms, and stronger accountability mechanisms that could positively reshape the country’s environmental jurisprudence. Issuance of this decision in favor of the petitioners promotes the public interest litigation.
